Summary of Facts and Submissions

I. The appeal contests the decision of the Opposition Division of the European Patent Office rejecting the opposition against the European patent No. 0 442 455. The decision was dispatched by registered letter with advice of delivery on 10 November 1999.

II. The Opponent filed a notice of appeal by letter received on 27 December 1999 and paid the fee for appeal on the same date. No Statement of Grounds was filed.

III. By a communication dated 28 January 2000, the Opponent informed the Board that no Statement of Grounds will be filed: "von der Einreichung einer Beschwerdebegründung sehen wir ab."

IV. In response to a telephone call from the registrar on 27. March 2000, the Appellant confirmed that no grounds of appeal have been filed.

Reasons for the Decision

As no written statement setting out the grounds of appeal has been filed within the time limit provided by Article 108 EPC in conjunction with Rule 78(3) EPC, the appeal has to be rejected as inadmissible (Rule 65(1) EPC).

ORDER

For these reasons it is decided that:
